I don't need a layer nor need money, but 300 seemed low and now that I said 1k I'm interested how this stuff works.

A couple years ago I got rear ended by a guy hauling a heavy arse trailer. He couldn’t stop in time and hit me going about 10-15mph. I thought it was crazy but I did have back pain after that only occurred when laying down. I was concerned something was wrong with my spine so I got it checked out. A quick X-ray and mri showed it was just muscular. I emailed the adjuster the receipts and she offered me $1,500 without even asking for it. I just wanted to be reimbursed from the doctor visit.

If he has regular UM coverage, he could claim against that since it doubles as under insured motorist coverage in Louisiana.

I just used my insurance for ER. I told the lady that and they said they'd still get it. I said how? Hospital doesn't have any info from wreck. She was like, they'll still get us.

No he didn’t. Not at all. All an attorney has to do is present an argument that there’s a 50.01% chance that the injury was caused by the accident. An attorney would take that insurance company to pound town over that with no problem.

It depends where the incident occurred (County/Parish can matter as much as State).

If I were you I'd at least contact an attorney to discuss course of action & potential value. You'll likely give away money if you do it alone.

Here’s where you may end up NEEDING an attorney.

Health insurance finds out the er visit was due to an auto accident. Health insurance says frick that, another party is responsible. They reach out to the insurance company for the at-fault party and demand reimbursement. If you’ve already settled, there’s a chance you could be on the hook for the Bill. Not likely but it’s possible.

fact! ex., where I live(DFW metroplex,) you'll likely get more $ if you get hit in Dallas than Ft. Worth(assuming it goes to trial)

If you actually had pain and suffering the fact that you are talking to the insurance company and not a personal injury attorney is mind blowing.

Now if you basically came out unscathed and are just jonesing for a little more cash from insurance I guess you are OK...but even in this instance there are PI attorney's out there that will take your case and probably get you more money.

Get a lawyer and try to get as much as you can, if that's what you want. 1000 is nothing for a car accident.

Former claim adjuster here. What's going on is they want the claim closed. The longer a claim sits open, the more money they have to reserve for payouts. Given you don't have an attorney and it appears you were just treated and released at the hospital, they know the injuries aren't severe. So they offered a settlement to get the claim closed. If you accept, they'll send you an agreement saying that with the settlement you waive any rights to seek additional settlement. SEnding the paperwork may get them to agree to the $1000, but that's no guarantee. Just know the people you're dealing with have been down this road 100s of times and know what they're doing better than you. If you don't have any lingering issues, $500 is more than fair, IMO.
