re: Insurance- how long to make a decision of a wrecked vehicle is totaled?

It’s a long story but basically after four months I would like the vehicle totalled. After numerous back and fourths with the insurance company and body shop plus many supplements submitted, we are about 10% short of the number for the vehicle being totaled. I’m sure once they take the vehicle apart to repair they will find more damage that will put the total repair cost over the threshold but the insurance company doesn’t think they can get much at a salvage sale to make it cost effective for them.

Can I just offer them some money to maybe meet in the middle of that 10% gap for them to total ? I’m just tired of waiting and want it behind me.

It's been probably 20 years since I've had to deal with the crap you're going through, but IIRC there's a 75% rule. Meaning if the parts, labor etc. are at or above 75% of the blue book value, then they legally have to total your vehicle. In either case, the 130 days is an unfair claims settlement practice and bad faith in their 1st party coverage to make you whole, so there are additional bad faith penalties you're entitled to. Assuming you're in La., file a complaint with the La DOI. I believe the link is directly left of Tim Temple's picture on the home page.

Our posts crossed where you said 10% short of the 75% mark. There are additional factors other than just parts and labor that count towards the 75%, some of those factors I believe involve intangibles. The reviewer at the La DOI will know all the factors, might be a good idea to call him/her and establish a dialogue. I would bring up Unfair Claims Settlement practices and Bad Faith Affirmative Duty, both of those sections of Title 22 is huge with regulators dealing with auto insurance complaints.

Could be that the vehicle is not "totaled" but there are still a global supply chain issues. I went through this a year ago. At some point it became more economical for the company to total the vehicle out then keep paying for rental, etc. even though the vehicle was repairable.

I haven’t rented another car. I guess I should have - maybe if they were paying for a rental it would have changed their mind.

Would a Diminished Trade-In Value claim add to the 75% total the insurance is looking at?

They don’t have a check either, Boss. I talk to them everyday.

Insurance company said some BS yesterday that it still going up the chain for approvals since it’s a high value vehicle.

It never is. They are out money on every thing going through a salvage auction. They never make money there.

who is paying that storage bill on that car? you are probably close to 4-7k for storage not including the tow.

Just went through this, although not this bad. Didn’t really see movement until we got an attorney involved. Even so we were at about 50 days when they decided to total it, and about 70 when we finally agreed on the value. Finally got the payment at the 90 day mark. Ours was a bit more complicated as it was a full size van with a wheelchair lift and other mods and harder to value.

Just went through this yesterday. At this point USAA is doing all virtual appraisals. So they give you an initial number based on owner photos. You then take it (or have it towed) to a shop and they start on it. Once they start breaking it down, they will submit another (supplemental) estimate to the insurance company. My issue is the car had multiple accidents and high mileage so I knew it would be totaled. BUT, the shop couldn't get to it for 3 fricking months. A lot of shops are backed up now. So I called the appraiser, explained the situation, he called the shop, asked for a few more photos of the undercarriage and within an hour it was totaled.

What supplements submitted without tearing down the car? Is the body shop trying to work with the first number given or are did they give a quote to fix the car? Independent body shop or a "preferred" insurance company body shop?
