This is the only partially correct answer. If you’re an employee on the job at the time of accident workers comp takes care of this. Let them take care of you to get you back up and running ASAP (assuming they can) so you can get back to making 100% of your pay and not the 66.667% of your AWW to sit on your arse. Unless you are denied some benefits (that you think you need or are you entitled to. NOT the ED meds you’ve been taking for years prior to the accident) you really don’t have a case for filing suit against the carrier/your employer. Workers comp is the sole remedy. If you think there was negligence on the part of your employer, the employer liability portion of the comp policy may kick in. Carrier would determine if they had a duty to defend the tort suit in that case.
You could potentially sue a third party if you thought there was negligence, but the comp carrier is already trying to subrogate against that 3rd party to get their money.
So unless comp denied something you’d only be making the attorney money right out the gate.

I know this opinion will make the dvs rain but generally speaking (in Louisiana), the “best” firms do defense.
The “Personal Injury”/“Trial Attorneys” (formerly known as plaintiff’s attorneys) have generally descended their portion of the trade to a Junk Bond-like morality rating.
I don’t care how competent they are at the shitty trade, I hate relying on shitty people.
When amoral people legally represent you, they’ll usually take any advantage over you legally possible rather than doing the right thing.
