So you see no difference between a neighbor and a predatory business that’s a small step above a loan shark?

It's kinda what people are doing today.
Maxing out "credit" to live like a baller.

Absolutely no intention of paying it all back.

Nope, I'd kill one of my cousins killer's kids. So he could suffer like my aunt and uncle. And shoot him in the balls so he couldn't reproduce.

You know liability doesn't die with you, right?

And put the burden on my family? Na, I'd make sure my family was taken care of and clock out.

This is all correct. Fraud of that nature is a financial crime, and if there is enough money involved they will sue you or your estate, refer you for charges even if you're dying, and/or attempt to claw back their assets.

sounds like they are going to be asking his wife and kids where the money is?

Kids should be safe. Most debtors should only be able to collect from the estate.

But I think in this scenario, the wife is f-ed.

Personally for credit cards? The estate is fricked.

The wife only has liability if she is on the accounts. She has no personal responsibility otherwise.

Its one of the shittiest things I've ever heard of someone doing but to each their own.

What estate? If someone is running up cards at the end of their life they have no estate.

My point exactly.

So, if they're in his name only the family has zero liability for the debt. The credit card debt dies with him.

If I had no children or wife, possibly. Normally I agree with paying your debts, but credit card companies are absolute vultures that prey on the weak. I'd probably donate most of it to worthy charities.

Some courts may not buy a last minute change in property ownership if an estate is running out of cash.

That house they share may suddenly need a HELOC, or worse a sudden sale if a court thinks the deceased had an actual stake in the property and the estate dips into the negative.

Agreed. The point is that if there is an estate the liaility for those debts goes to the estate which means the debts would have to be satisfied in full before the wife (or inhertitors) get a cent.

To be clear, we are discussing unsecured debt here. Secured debt is another issue to be dealt with.

Heh, maybe. But if it were a toss-up for the guy before the ill-advised deed, maybe it helps slam the Pearly Gates shut on his fingers.
