If this was the 19th in BR, I was dismissed from that pool Monday. During selection, the defense was getting every white guy with a daughter out of that room as fast as they could.

Sounds like this will be in the court system for years. First round will be the appeal project. Then it will be jailhouse lawyers filed as pro se. it will take up a couple hundred hours of court time.

And the guy will be in jail for life.

Seems like the right result.

I had jury duty a few weeks ago.
It was a drug case and the defense was going to be that the driver of a car was not in control of drugs that were in the cup holder, claiming that the drugs belonged to someone else.
I said that none of the occupants had any business being in a car with drugs in plain view.
I was sent home, but only after sitting through the selection process for six hours.

The verdict was guilty.

I realize the evidence in this case seemed overwhelming, and it was tough to deal with, but...
I anticipate this quote being part of a motion on defendant's behalf in the near future.

Tuesday court for a drug case. Defense attorney questioning his own client on the stand about being employed. Reading from his notes.
Attorney - Where were you employed at the time in question/?
Defendant- I didn’t have a job.
Attorney - You told me you worked at Street Corner Pharmaceutical is that correct?
Defendant - I never said that.
Attorney- didn’t you tell me you were employed at Street Corner Pharmaceutical?
Defendant - That wasn’t me.
Attorney’s assistant whispers to attorney.
Attorney has shocked look on his face, “no further questions your honor.”

Oh he won’t be in that long. They will probably be wheeling him out the back after he gets room temp sooner rather than later. Child molesters are instant targets in prison.

On my first jury the defendant was charged and convicted of raping his
granddaughter.

I went to a bar after that trial as if was so disgusting and messed with my head. Victim was a five year old.

I'm kind of glad mine ended in acquittal, when we were in the pool during the selection process and were told the charges I'll bet over half the people were ready to convict without hearing one word of evidence, as it turns out there really was no evidence, it was just a teenage daughter acing out, if convicted it would have been effectively a life sentence due to minimum time served requirement and the accused age

Kudos to the one that did report it. I get why some wouldnt, but man if you knew it was true that whole time and didnt do anything.

I edited. Feels like it would be hard to prove that him not testifying had an impact considering it was never spoken out loud in the jury room, but I guess I’ll set my pride aside to be safe

Damage has already been done.

You prejudiced your decision based on his refusal to testify, but he obviously refused to take a plea deal and went to trial, which can be inferred as a declaration of innocence. Multiple ways to look at this.

If there's a re-trial, that girl will have to live all of this again.

Tough situation for you and especially that girl.

Maybe you could find a defense attorney in your area and find out if you are now obligated to disclose this. Dude had a 5th amendment right to not testify and a 6th amendment right to a fair trial. You were given instructions from a judge.
