I know you meant well, but it's not a handout and it's not yours. This man earned it. It's his money. He just needs to go get it.

If you are really struggling, go apply at a restaurant. I don't know how bad your arm is, but plenty of disabled people work in the industry.

Plus most of these places just want someone who will show up on time willing to work.

I'm not trying to be an arse here. But until you explore all options, you aren't struggling. And you may have to do something you don't want to do until you can find another job.

This is why I have no sympathy for people without jobs. Hell I was at Sears yesterday, they had a big now hiring sign out front. So many places are constantly looking for help, if you don't have a job, you are making that choice.


That's not entirely directed at you though, I know you've had a rough go at it with the trial and everything else. But you may need just work part time for a lil bit.

Not necessarily. I've been moving around all over the country, as well as overseas, for the past 5 years now. If it's worth it, I'll consider anything really


If moving is not an issue you may want to look at Southern Company. They are in the middle building 2 more nuclear reactors outside of Waynesboro Georgia. You would probably have to go in on the construction side with Fluor Daniels. I don't have a direct "in" for you but I know lots of folks working there that could probably help. Great pay considering the cost of living in the area.

Cork, you're a good man and a tough SOB. You'll get through this and whoever scoops you up will be very lucky.

I don't have any input on the job front (for now), but hit me up if you need anything else. A place to crash/home cooked meal/a few beers and an ear to bend, if you're ever in Houston.

That is a BS line that most company's try to sell to avoid paying claims. Even if you broke the arm a month earlier and was your first day back, you would still be eligible for benefits because the fall exacerbated your injuries to the point that you required new treatment. I was a WC adjuster for 5 years (7 different states, Longshore, Jones Act...) and a reputable adjuster wouldn't even think twice before paying this claim. If it was a back/neck, we would investigate it but would have to pay lost wages because it wouldn't be worth the penalties if we were wrong.

If you are a Longshore worker, the attorney cannot touch your reward, he has to file his hourly invoices to the insurance company and they negotiate payment at the end. State & Jones Act will take up to 33% (maybe not TX, did not do any State claims there). Also, if your attorney requires a contingency, drop him NOW.

Finally, if you are at your wits end, talk to your attorney about it. If your claim is strong (which I believe you have a 100% chance based on info posted so far) they typically will help advance some funds.

You've been paying into it all that time. Unemployment isn't a handout and it isn't the government taking care of you; it's you withdrawing your savings that the government has been holding for you.

And if you really don't want to look at it that way try this:
You've been taking care of a lot of people over the years who have run up against it. Now there are people willing to pay it forward back to you.

Either way, it's yours already, not a gift.

Well what do you think all those taxes that you paid went for? Don't you think you deserve some of it back to help you out in your time of need? Don't feel bad about it, and it probably won't be close to what you are used to making, but it will be better than $30.

Cork, please don't think like this. Yes there are a lot of bums taking advantage of government programs but they are are small minority and have nothing to do with you. Further, unemployment isn't just a handout, it actually is beneficial to both parties. It prevents professionals like you from desperately taking a McDonald's job just to pay the bills every month. It's better for taxpayers for you to be able to afford waiting around a little bit for a more appropriate job with the corresponding taxes than it is for you to get desperate and take the first thing that comes along and you pay nothing.


But it's not even about that. We all (including you) pay too damn much in taxes for someone like you to be scraping bottom because of a hard time. Take the help and make us all feel better, you'd want the same of someone else.

I'm going to work in NOLA this week to run a project at a friend's company. It's only supposed to last a week or so but its something, and hopefully it turns out to be longer.

You 100% should if you have always paid into the system and its a short term thing, all you will be doing is recovering YOUR stolen money.

Hate to hear that you are struggling, man...hang tight and make good decisions and things life will turn up for you.

how much longer will the doc have you on light duty?

has your doc released you to drive?

as the others say, you need to apply for unemployment insurance ASAP, as it may be a number of weeks before it comes through for you....if you were terminated for cause or quit on your own, it may not come through at all.

I applied for unemployment.

Define "fired for cause." They said they fired me because I wasn't able to complete my job abilities due to my injury, the same work-related injury I got working for them and didn't receive Workers Comp for. I didn't get a pink slip or anything though, and the company has now closed its doors.

Their Workers Comp insurance company is liable so if all goes well, which I pray it will, they'll be held liable and have to pay. My lawyer is pretty optimistic.

ETA:

I can drive. I can't lift more than 5 lbs for the next month, then I can move up to 10 the next month and then 15. My next doctors appointment is in three months, I expect to be cleared 100% by then.
