I need help regarding getting backed into causing body damage

I got the police report today. The guy that backed into me got cited for no proof of insurance. There’s no insurance listed for him on the report. What’s my next step? How do I find out with his vehicle information what company he’s under or not under?

If he was cited for no proof of insurance I’m going to take a wild guess and say he was uninsured.



I would contact your insurance company or a lawyer who can likely help you better than the random people here.

It all depends on your state. Some states allow you to drive uninsured, some don’t. If you’re in a no fault state, it’s a different thing altogether.

Best bet is to call your insurance company and have them go after the guy or call an attorney.

Your next step is file a claim with your insurance with this information. Do you have uninsured motorist coverage?

Sounds like he provided no proof of insurance. Doesn't technically mean he doesn't have any...but my guess is you already have your answer.

Either way, your insurance company will run this down.

Geico told me I’d have to pay the $1000 deductible on my collision insurance and then they could go after him.

That’s the cost of playing ball. You have to assess how much the damage is and whether it’s better to fix it yourself or contact a lawyer (they’ll cost just as much) or rolling with your insurance company. You’re going to be out some money regardless in this situation. They may be able to recover your deductible if you have the uninsured motorist rider and the accident isn’t your fault. But you’ll have to pay it to get the ball rolling.

That’s the cost of living in a world full of dirtbags.

File under your policy, cough up the deductible, if he has insurance your insurance with subrogate and you will get the deductible bak, if he doesn't then you are out the money.

If Geico recovers their costs from him or his insurance they have to pursue your deductible too and return it to you. That could take months though before you see it (if at all, if they can’t recover from him). If they only recover part of your damage, they have to return a proportional amount of your deductible.

For example if your damages are $4000 and they only recover $2000 (50%) then you would get $500 back (50% of your deductible).

Thanks for the help baws. I’ve had a bad week so I apologize if I’m pissed.

I do have a witness and the security footage from the gas station I was at that shows him backing into something because his truck bounced on film.

a copy of the police report will state what he claimed to have or not have.

the rest you go through your own insurance as the uninsured driver coverage. most people dont know what that item is and just look at the other coverage, but it is there just for situations you are in now. also be aware if its a big money fix, they may cancel you after paying it off.

There is something you can do (before the fact) to protect yourself from a problem like this and that is to buy uninsured motorist insurance. Hopefully you have it.

ETA
I may have misread the title. If you meant body damage to the car as opposed to bodily injury, you collect that under the collision portion of your policy, not UM.
If the other guy doesn’t have insurance here is one way to recoup your deductible. If the other driver got a ticket, tell the DA that you want restitution to be part of his deal. Sometimes they will do this.

When I was younger, I had some dicknozzle hit my car in the parking lot during a softball game. I ran up and confront the guy as he was driving away, and he just mouthed off and left, but I got his tag and people knew him.

Uninsured motorist deductible at the time was $500, I think, but the joy of picking the dude out of a book at the Sheriff's office and having them go to his employer and pick him up on outstanding warrants was priceless.

Contact your insurance company so you can get your car fixed. Go after him in small claims court for your deductible. In my experience, there’s a reason some people are uninsured….and that’s because they typically don’t have any money.

Get your car fixed and try to get your deductible from him….but don’t let it ruin your life if you get none of the deductible.
