Absolutely in Louisiana. Comparative Negligence. But it's only used in awarding damages I THINK. I wouldn't want her jailed after losing children but she is most definitely part of the reason they perished.

We have a few as well. He seemed like he was a fun-loving laid back dude. But drinking and driving is stupid and can change yours and innocent peoples' lives in an instant.

Yea it's just one of those tough calls.
We took all four to down to the Audubon Zoo Saturday.
And of course two were passed out asleep before we got back to I-10 on the way home. I still make them keep the shoulder belt on when they slump over(kids love to move that part of the belt behind them to get comfortable).
I just feel bad as a parent but equally angry at her.

Aisha and a 12-year-old passenger were also not restrained and sustained serious injuries

Right, Comparative negligence has nothing to do with her criminal liability. I wouldn’t want her jailed either, although it is frustrating to see little kids not buckled in. Jailing this mom will not change things.

I notice black kids in particular are often unbuckled. It’s crazy to me. I know back in the day before people knew any better the kids would be unsecured but nowadays it’s just sheer stupidity.

how hard is it to wear a gd seatbelt. mother should also be arrested for not restraining her 1 month old.
