Gravity + momentum + mass of falling drunk guy is a lot to have suddenly stopped by impact with concrete.

Hematoma/hemorrhage would cause swelling and if not controlled eventual death

Seems like self defense and freak accident. Unless MM kept punching Repath after he hit his head on concrete, i don't think a jury will find MM guilty of murder. Repath punched first both times and there are consequences for your actions. And a 26 year old man really shouldn't be hanging out in a college age bar, just sayin.

Dude, I just dropped into this thread on page 32 or something and saw the name and started freaking out a bit. I had to frantically go back a few pages before I saw he was 21. I was legit worried for about 5 minutes. Whew.

Don't mean to make light. Sucks for everybody involved and all their families. This probably happens hundreds of times every single night in bars in towns all across this country. Minus the freak accidental death, obviously. But that could have happened to most of us. Hell, I was involved in more than a handful of what sounds like similar situations. They usually wound up defused, with us getting up and buying each other drinks. We were lucky, though. shite happens. Just hate that this shite happened to end up in a death and manslaughter charge. Again, terrible for everybody involved. I hate it. But I am still relieved it didn't involve Z. Would have hated that more.

Police said Repath swung at Marsiglia, who ducked and then pushed Repath to the ground — where he hit his head on the parking lot pavement. Repath was taken to a hospital and died three days later.

If these are accurate facts, then not guilty all day long. How was this even charged?

That or the report is being quite euphemistic with what the Defendant is alleged to have actually done.

Wasn't Repath escorted out of the bar by the bar security and Marsiglia followed him
So you can't really say self defense when he followed him out of the bar
Now if Repath had went after him then that would be considered self defense
The manslaughter is because Repath died and I would be surprised if he gets any jail time

This can't be right b/c we were told by several OT poster extraordinaires that just b/c there is a fight and someone dies doesn't mean that someone would be charged.
