This is a total "it depends"

If she goes on a cocaine binge, fricks 12 guys and the proceeds to kill a homeless man, then no.

If she kills a guy breaking into our house, then yes I say I pulled the trigger and take my chances. Luckily I don't live in a liberal state so I should be fine in that situation.

No way I'd do that. If my wife is doing something that warrants a prison time, then the hell with her.

Not married yet, but this hypo only really works if its like negligent homicide for accidentally killing a pedestrian or something. Then maybe you'd have some situation where it'd be more important for her to be with the kids than you for a couple years.

But if it is anything truly nefarious, drugs, violence, dishonesty crime, etc., why would I want to keep her around the kids at my expense.

Depends what you mean.

Would I kill someone for threatening my wife's life and ultimately serve time in prison for it? Sure if I felt it was justified.

Would I help my wife rob a bank because she wants more Louboutins? frick no.
