I wonder if having a license that allows me to operate a motor vehicle on public highways means I have to turn in my liquor in my liquor cabinet?

Do yall think I should bury my liquor in my backyard or drop my auto insurance and start driving without license and insurance?

This cannot be all of them, can it? This has to be a subset with some other "risk factor" right?

Per the article:

quote:

In the letter, Ballard cites Hawaii Revised Statutes, Section 134-7 (a) as the reason for the move. That section reads: “No person who is a fugitive from justice or is a person prohibited from possessing firearms or ammunition under federal law shall own, possess, or control any firearm or ammunition therefor.”

What the frick does this piece of legislation have to do with marajuwana?

In a letter to about 30 medical marijuana card holders on Oahu, the police said “you have 30 days upon receipt of this letter to voluntarily surrender your firearms.”

If I surrendered anything it would be my card first. Tons of pot there.

You want to know why having to register your guns is a big deal? This right here is why. Hawaii requires you to register your firearms.

Somebody stoned on cannabis is far less likely to shoot someone than somebody that is drunk on alcohol. Those Honolulu cops should be much more concerned with all the meth tweekers around there shooting somebody rather than a pothead. But it's usually really stupid frickin people that run this country.

18 U.S.C. § 922(g)(1-9) prohibits the following from possessing, shipping/transporting, or receiving any firearm or ammunition:

(1) a person convicted of a crime punishable by imprisonment exceeding one year;
(2) a person who is a fugitive from justice;
(3) a person who is an unlawful user of or who is addicted to a controlled substance;

Seems to me, if it's legal and prescribed, they're not "unlawful users".

I'll be curious to see how this plays out. I don't see how they can legally do this, or attempt to do so.

Federal law supercedes state law so it's not legal and they are all "unlawful" users.

And this is why the Feds must reschedule. Simply telling the DOJ not to prosecute med mj cases isn’t good enough. fricking Obama could have got this done.

That is correct but...

Marajuwana is illegal per Federal law.
Hawaii refuses to enforce Federal law and in fact, issues licenses to break that law.
Hawaii then uses an associated Federal law to confiscate weapons and in doing so violates the Constitution for behavior that they themselves are illegally licensing for.

Apparently the citizens of Hawaii arent the only ones smoking dope. Are those sheriffs getting in the evidence locker again? Shame.

meh,
If it required a constitutional amendment for the Feds to ban alcohol... clearly current federal drug laws are unconstitutional.

Only where Federal law actually has standing. The Federalies dont actually have constitutional authority to regulate drug use within the various States. They hide behind the commerce clause to regulate it between the States. Which is a fricking stretch at best because its not regulating anything theyre outright prohibiting it.

I think the only reason they havent challenged the States over this in SCOTUS is because they dont want to open that can of worms. They stand to lose ALL their power if they do that. They would rather people believe they have a power they dont then to challenge the States and remove all doubt. This is what "States Rights" are all about.

frick yeah!

Unconstitutional, and it's not even debatable. This won't stand for long.

Yes, but if memory serves, you also thought unemployment payments came from your "account" into which you had 'paid' said funds. I am not too sure that you are able to grasp the intricacies of legal issues.

Weren't you also going to look up Terd Ferguson and whip his arse when you returned on a visit to Louisiana?

Let me know if I am way off base with this...after you finish your Doritos.

It could stand forever if someone doesnt challenge it and with only 30 people affected it may go unchallenged for a very long time.
