This does happen and has been happening for a while (they call themselves 'otherkin') however this story in particular is more of an internet legend that's supposedly happening in every town- kind of like snakes in the ball pit at McDonalds
There is no attorney alive who would take that case
ETA: this rumor is everywhere...

Is it bad that we live in a day and age where when I heard this I thought the idea of suing over such a thing was absolutely ridiculous but at the same time seemed completely plausible that someone would try it?
