I'm hoping that smarter heads prevail, considering this is a huge project on a major city intersection, not a flooded out crack house in the east.

My understanding of this deal is that after construction, 1031 Canal was still going to own the building (or maybe they sell to another investor) but Hard Rock was going to completely run the show under a management services agreement.
In a typical hotel "flag" contract, you still have an operator who licenses the IP from the chain.
I think this was meant to be more than that. Hard Rock itself was going to lease the building and be the operator, probably on a triple-net lease.
So I don't think it's a licensing agreement per se.
Having said that, no doubt that Hard Rock got into bed with these clowns, a decision I am sure they regret.
