Yeah but lawyers know it's not about right or wrong, it's about the settlement (because that is cheaper and "safer" than court...)

Literally none of this is true.

If a patient dies in a hospital, then the physician can order an autopsy if the hospital has a pathologist who will perform it. They are not obligated to order it, but typically will if the family requests one. The autopsy would be paid for by the hospital. Once a patient is discharged, then the hospital certainly has no obligation to pay for an autopsy. The medical examiner’s office would likely not take this case either, leaving the only option for the family to pay for a private autopsy.

First, I want to thank all of you for what you have done to help this family. Carri is my niece, this is very real.Carri's mom is my husband's sister. While I don't know (David) Eric well because they live in another state, I can tell you the whole family is devastated.
I'm sure David is overwhelmed right now and will be back when he is able. Please continue to pray for them. As soon as the obituary is released, I'll try to post it here. Thank you again. Carri will be sorely missed by her friends and family. This is her Facebook post following the surgery. I don't know how to attach the pic without downloading and saving it.

The GFM had exceeded its goal and Chicken doesn’t particularly care for GFM’s on here because of the inability to 100% verify the story as authentic.

I'll second this. Please let us know how your BIL is doing if you can. We're worried about him and his physical and mental state.

I will get the ages. One is an adult with a child of her own. Carri was a young grandmother. The other two are teens.

The kids that still live at home are 12 and 16, the other daughter is 22 and has a 2 year old. I'll wait for David to respond with how he wants to proceed with Christmas. Thank you all again. Our hearts are broken.

I'm not going to argue this but I've been a physician for >10 yrs and involved in more than one autopsy that related to the death of a patient who was admitted less than 24 hrs prior. You may be right, and my practice is primarily out-patient now, but I can't imagine a hospital is "off the hook" as long as the patient is discharged. Admittedly, I'm speculating and it appears you know so perhaps you are correct.

The settlement is capped. In Texas the most you can receive is $200k. You need to have a very strong case for a law firm to take you on.
