Well smith was so plastered he probably whiffed on every punch. Surprised he was even able to walk straight being 3x the legal limit.

No doubt. I agree. But once you pull a gun out, we know bad things usually come next - and they did.

nice to see that the article says hayes stepped out of his vehicle after HE crashed his car into the mercedes holding his .45 already at his side... this was way before mr will smith acted like a meanie head. Hayes steps out, brandishes his .45 first and then shoots someone dead 8 times. Sorry baw, you going to fricking jail.

Cardell opened the driver's door, stepped onto the pavement. He had his .45 in his right hand, held at his side, pointed at the ground. In New Orleans, that is a perfectly legal thing to do.

You're talking about Smith or Hayes?
Smith never had his gun. If pulling a gun isn't considered threatening, why would Hayes fear for his life when Smith never even had one at the time?

per article, hayes runs down a hit and run guy cause he mad about his insurants hikes and then happens to crash into vehicle smashing rear window then legally steps out of vehicle with a .45 but does it a i'm a white guy who can protect myself kind of way all the while mr smith is taking swings and misses while hayes had a .45 etc. article was a fricking agenda driven pathetic piece woe is the life of this good ole black kid literature.

No matter what the article says, Hayes should've never gotten out of his vehicle with a gun in hand (especially considering the fact that he hit Smith from behind). Both parties are responsible for what happened, but Hayes getting out of his car with a gun in his hand sent the whole thing to another level.
i still say if will smith wouldn't have hit and ran, nothing happens at all.

It's really weird. At the beginning, most people (reasonably given the minimal facts available) assumed that it was a random act of violence or that some dude killed Smith simply because he felt disrespected or whatever.
Then as the days passed it became clear that the narrative that formed immediately after the incident was false and most agreed that it was false and that more facts would be needed to truly determine fault.
For some unknown reason a couple of holdouts, chad being the most vocal, have doubled down on the initial narrative.

Hayes shot Smith in the back 7 times, and shot Smith's wife twice. No other shots fired, and conflicting accounts of another weapon. He's going to jail for a long long time.

The writer pretends that this was a logical move. You just chased down and hit a car that apparently hit you first and you get out of the car with a gun in New Orleans (a place where people kill people for looking at them wrong)? I watched the original video many times and I couldn't really tell if the cars hit each other, but I'll assume they did since Hayes went after him. Smith was driving like a jackazz. But anyone that jumps out of a car with a gun in any kind of possible hostile situation has really escalated an issue into something life threatening. And of course, he took a life.
Yeah, Smith may have escalated the situation in the first place, but it didn't become life-threatening until Hayes stepped out with his gun.
