Unless Smith said, "I'm gonna get my gun and kill you" it doesn't matter. Hayes already had his gun in his hand. Smith never had possession of the gun because Hayes didn't even say that he had a gun in his hand (and his lawyer would have been the first one screaming about it if he had). Don't forget that he shot Smith's wife multiple times too - she didn't have a gun. They both acted with stupidity and now one has lost his life and the other has pretty much ruined his.
