Got in my first wreck Wednesday (Rear-ended).

They say my car is totaled and the guy didn't have insurance.

What can I do in order to get a new vehicle?

Am I f*cked?

Do i have to sue the guy or what?

I paid cash for the car in 2015 (2014 Ford Fusion) so I don't owe anything on it for reference.

Hope you have collision on your policy or you will be paying out of pocket for a new vehicle.

First step: call your insurance agent

also, suing someone that is too poor to have auto insurance probably won't get you much


EDITED from uninsured to collision because I was wrong

Good luck finding a lawyer to take a case with no insurance on the other end. Do you have reason to believe the guy has anything? Most uninsured drivers are uninsured because they can't afford it.

The coverage you are looking for is collision. Uninsured property damage is the other, but it is rare.

Another option is to pay out of pocket to have it fixed, if it is fixable. It might cost more than it's worth but nothing requires you to scrap it. You can put whatever money you want into getting it legally drivable. The title doesn't get "totalled" until you sign it over to an insurance company who will then total it legally. As long as you have that title, ain't shite totalled until you say it is.

Yes I have insurance, but im not going to lie, my wife takes care of stuff like that. Im not sure if I have "uninsured motorist" on my policy or not. Im really pissed but thanks for all the info everyone. Guess ill have to dig deeper into my policy

He may recuperate some money in the future but like I said he will be paying out of pocket for now
