Get a lawyer to look at it. Sometimes, not always, if the company has knowingly violated their own policy you may get it out of comp.
Not a divorce lawyer, somebody that does shite like this everyday.

Thank you. I contacted a lawyer through my brother, who works for a prominent businessman in BR. Wont give his name but referred me to someone in Lexington. I live in Louisville

If you use workers comp you'll only get 70% of wages when out of office.

Seemed like it at first. Lined up from the "cooling" tower which is always set around 96F.
Oh, it’s hot in the summer. Believe me, I know. God doused with hot 1,1,2, trichloroethylene from a line that wasn’t supposed to be pressurized one night and went to the safety shower and it was hot as hell. But not above boiling.

Do I have a case?
This is not legal advice since there are too many factors potentially at play. Just a general overview of what might be a similar situation and it will vary based on the facts of the accident along with the particular state law.
You have a comp claim which will cover the medical bills, lost wages (at the state rate) and there will be an award for permanent impairment/disability. States vary about how comp covers scarring/disfugurement.
Unless there is thrid party negligence you won't be able to sue anyone in tort. Comp will be the sole remedy. There may be some thrid party fault with the tanker itself but one needs a lot more facts.

Dont ever get hurt on the job.
OP talk to the lawyer before you give a statement or see a "company doctor". In this case neither the company or the union is in your corner.

NO SOP bro. I worked at Dow Chemical, Shell Geismar, and Marathon Garyville, for a contractor and loaded everything from rail, trucks, to marine docks. All of them had SOP'S no matter what. Dow had a 4 pager on how to wrap Teflon on loading L pipes.
Wouldn’t some of that experience translate to you not being burned at your current job?

True, never count on the union to have your back.

How well did you sell the pain on-site? That may be worth a few $100K more

Is there a SOP to do a JSA for a task if you don't have a SOP? If so, did you do a JSA? Did a supervisor review it with you?
If they don't require a JSA for performing a task with readily identifiable hazards that do not have a SOP, then I'd say that's a problem...for them. But talk to a lawyer...

this clarifies the procedure that states "go to the company doctor before you do anything else". Ive always wondered why that existed

If true they have already contacted you to settle. Of course you have a case.

Why are you trying to drive business out of Louisiana
Posted on 7/16/22 at 6:35 pm to ChestRockwell
