It's standard for surgical consents to include "any other procedures deemed medically necessary" because you can't always anticipate exactly what you'll find inside. The surgeon could MAYBE argue that he saw something wrong with the right kidney that led to the decision to remove it. However, removing the kidney without consent and leaving the adrenal gland that was supposed to be taken out is pretty much indefensible. His malpractice carrier will settle with her for a hefty sum.

She probably will get paid because the majority of medical cases settle instead of going to trial anyway. Not necessarily because the physician did anything wrong.

More details would be necessary. The adrenal gland and kidney are very closely associated.
It's very possible that the mass was involving the kidney and needed to be removed but for whatever reason the mass was subtotally resected requiring a second surgery. But who knows, we are only gettinginited details here.

I’m not a doctor, but I’m just not sure how a surgeon removes an adrenal gland instead and places it in the little metal bucket and thinks to himself “got it”. Also, nobody else noticed? I’ve had my fair share of operations and EVERY time at every hospital the surgeons come in and state clearly and ask clearly what the purpose of the operation is. She’ll get paid.

Yeah, this. Not only mark it, but I thought like three or four people sign the area as well. Patient, nurse, surgeon, etc. so that mistakes don't happen and everyone agrees on what is to be done.

No he can't; that's admitting a huge frickup. To even SEE the right kidney, he'd have already had to have committed massive malpractice and cut open the wrong side of the patient.

EDIT: Nevermind. I misread. I thought it was a left/right thing and not an adrenal gland/kidney/TigerstuckinMS can't fricking read kind of thing.

They do.

I had surgery on my left shoulder and no less than 5 people came into my room and wrote on my left shoulder before the surgery.

That’s pretty bad. I can understand going to remove and adrenal tumor, finding it more advanced that originated balky thought and having to take the kidney with the adrenal gland.

But to go in for adrenal Surgery, Miss the adrenal and remove he kidney by itself is unfathomably bad.

Also interesting that the guy is a colorectal surgeon but he was trying to remove an adrenal gland.

In a place like Sioux Falls, you take what comes in the door. The general surgeon in our little BFE hospital also does endoscopies and skin biopsies.

I get that. But at some point the surgeon has to be honest with himself. Adrenalectomies are a relatively uncommon operation and the surgeon should refer out of he’s not well versed in the procedure.

I had a brain tumor removed. Before the surgery, some stupid frick came into the room and had a marker and put an X behind my head on my neck at the hair line (skull base).
I thought he was putting an "X" meaning "not here!". I just curiously questioned him on it and he says "oops"
I came unglued. The moron had the xray flipped (see thru) and it made the tumor appear on the wrong side.
All kind of apologies happened.
Other things happened wrong that day, and I'm currently involved in a lawsuit against the physician that fricked up. It's been 6.5 hears.still in legal crap, trial not in sight. The legal process for this shite is fricking insane.
This woman has an easier road because the physician CLEARLY was outside of the scope of the surgery. And the kidney was healthy.
