You're fricking retarded if you let them stick you with 25% of a bill that isn't your fault.

I’ve already consulted with an attorney. Without a personal injury claim to go along with the property damage claim, it’s pretty much isn’t cost efficient to hire an attorney. It’ll just drag it out longer and I still won’t have my truck back.
fricked either way!

So you were sitting in the center turn lane to get into traffic? Is that what you're saying?

Do not accept 75% of anything. Only a jury can decide percentages of fault. Have you seen the crash report? If they are at fault they are liable. They are trying to take advantage of you because you don't have an attorney. Your coverage does not matter unless they don't have enough insurance to cover the damages.

Yes, it’s near SLU and super busy that time of morning. I couldn’t just immediately pull into the travel lane.

If it was a minor accident, you don't want to take State Farm to court.

Here's two things to do:

1. Call your insurance company. Even if you're not making a claim, you call them and see if they can handle the SF negotiations. I've had this happen before--although I had full coverage at time, but it's worth a try.

2. Don't sign a release when they give you money for the repairs. Then send a demand letter for the balance.

I find it interesting that you did not state in the OP what reason SF gave you for offering to pay 75%. Is it because they say you were 25% at fault? If so, get the police report or other evidence that the fault was the other driver and send it with the demand letter.

If you were at fault, then eat the 25% and discuss the pros and cons of comprehensive insurance with your wife to avoid a recurrence of this scenario.

Yes, I have the report and the Trooper has her listed as not seeing me until she hit me.
She was ticketed for failure to yield from a private drive.

Only according to State Farm, I’m 25% at fault.
Police report and my insurance’s Liability investigation says the other drive is 100% at fault.

Progressive has been negotiating for me with no luck for 2 weeks.

I suspect that's why they are refusing to pay the full amount.

you only other option if SF won't pay is to sue the driver who hit you (or anyone listed as owner of the vehicle). You can't directly sue SF unless the laws have changed recently. As you said, not really worth a lawyer.

You might can call SF and ask to speak to corporate or escalation dept, etc. I once did that with a different insurance company. I finally got high enough and annoyed a woman enough she agreed to pay.
