Because the employer has proof of excessive sick days, they have "plausible deniability" for reason for the firing. Louisiana is an at will state, were it not for the text, they could have fired her anyway. The text put them in a tight spot, the excessive sick days mitigated that a bit.
A civil suit will have other criteria regarding damages vs improper termination, I would think. But not being an OT lawyer, I welcome any thoughts on the matter.

I workout at this gym once a week. It is very racially diverse as far as the customers go. Not sure why this guy would say that to an employee that works in a place where a lot of racially different people work out at.

Are they positive this is the guy that said it. He looks like 90% of the white guys in Slidell. A good lawyer could make the case for mistaken identity.
