Even if you don’t plan to file for the damage, ALWAYS file a police report for an accident.

Matters because I’m not going to handle that situation the same if it’s some 16 year old high school punk or some 35 year old bmw driving prick. She was old, fat and black. That’s a rough hand. Probably more broke than me too, so my reaction took all those things into account.

Report it to your insurance company. If the other driver decides to sue, you will be protected (somewhat—as you didn’t have a police report helping your case).

Even though it may have been her fault, you have nothing official stating this now, and you don’t want your insurance company to get blindsided and you possibly not being covered in a suit because you didn’t report it.

Always file a police report, even if no damage...there are many litigious people out there...it is to protect you.

Agreed, but is it so unnecessary to give a description of the other person? Would it be just as unnecessary if she wasn’t fat, black and old?

Always get a police report when you know the other driver is at fault, especially when...

Thought about that one immediately. I grabbed my phone and started recording the audio when I got out of the car so I have the whole conversation. I asked her if she was okay, and if her neck or head hurt. She said she was fine. No worries.

Your insurance isnt gonna go up if she was at fault. And you make the claim against her policy and you won’t even have a deductible. But without a police report, you’re probably out of luck unless you have her insurance policy info to make a claim and hope she tells her insurance the same story you do since you don’t have a police report to back you up if she tells her insurance something different than you do.
