The two teenaged survivors were never charged with any crimes and they have received no immunity for anything that may have happened that night
So it will be interesting to see what information is contained in those sealed files. Supposedly it is everything but Fontenot's defense strategy.

i'm not sure what Constitution you live by, but everyone is entitled to a defense.
and i would also think "1st degree Murder" is very much debatable.

Why are they unsealing the file now? Has a plea deal been reached or has the venue already been changed? I'd think they'd be worried about a tainted jury pool, which (I'm guessing) is probably why it was sealed in the first place.

State going for 2nd degree. He'll plea to manslaughter, I doubt he wants to chance a life sentence with a jury verdict of guilty to 2nd.

quote:He fired more than" a shot". He shot all three kids in the truck, so at least three shots, probably more. Pretty shitty aim for warning shots. I knew the kid that was killed and as far as I know, he wasn't some juvenile delinquent.
When the truck w/ the kids returned, he went out to the street and confronted them, firing a shot "to scare them"

Should've have typed don't argue with me. It's the law, I can't change it.

I don't know the Fontenot kid or if he's "a danger to society", but he's definitely a fricking moron who should do at least 10-15 years for what he did. Who the frick shoots into a truck driving away down the street?

I hadn't heard all three were shot, just that one was killed. I believe Fontenot's explanation to police when he was picked up at work the next morning was to the effect of firing a (or multiple) warning shot(s) to "scare" them. (Which is retarded in its own right. If you're going to start shooting at someone, you ought to be trying to kill them.) Was Fontenot drunk or is he a dim bulb or something? The whole situation seems moronic to me. I can appreciate the frustration associated with being the victim of multiple vehicle burglaries, but his decision to head out to the street and start shooting seems really dumb.

All three were shot, only one died due to being struck in the head.

Why wasn't Fontenot arrested, or at least questioned, when it happened? I remember him getting picked up the next morning at the restaurant he worked at. Has he been in jail for two years? I thought I remembered him bonding out pretty quickly.
Even if he beats the criminal charges, which seems unlikely to me, him and his parents are probably going to get fricked civilly (it was Seth's parents' home where the shooting took place, correct?).

He was arrested and posted bond. He was later arrested on 'distribution of CDS' charge. There is already a civil suit filed on behalf of the deceased kid. Yes the incident occurred outside his mother and step father's residence.

CDS=Controlled Dangerous Substance? If so, maybe Seth really is an idiot.

I see him around campus all the time. He's been bailed out

Oh, well your random hypotheticals came off to me as arguing my point.
all you said was you can't shoot someone running away, which i disagree with in certain instances, but not in the case being mentioned.

Prosecution wants to turn away from what the boys were doing on foot in the neighborhood and make it about Fontenot's actions solely
Defense wants it all to come out to provide context to Fontenot's actions

Isn't the prosecution required to disclose all information gathered during the investigation to the defense? Or at least that's my understanding. (I've seen My Cousin Vinnie at least ten times, so I feel qualified to make this observation!)

If you see a kid stealing a stick of gum from the Circle-K do you have the urge to shoot them in the face with a shotgun? Justice Ya' know?

I'm pretty sure the QB from Teurlings (Cole Kelly) that LSU is looking at was one of the kids in the vehicle at the time it happened, correct me if I'm wrong.
