Perhaps, but to what degree? Very minimal. I can say with tremendous confidence that I've driven drowsy before and felt it was significantly more dangerous than on occasions when I've driven after a few drinks.
The point really is that people have to understand that there are nuances that have to be taken into account on this issue and that blanket statements or judgments are dubious. There is no sacrosanct number on BAC. This crime, like most all, rather than being dogmatically attributed to a measurable has to be attributed to variances in individual behaviors as well.
What I find most problematic is the stubborn attitude that persons driving at .08 or .12 are some how morally equivalent, and thus justifying punitively equivalent actions, to the driver who is absolutely shitfaced going 150 mph down the highway.
A simple solution in my opinion is implementing a scale for punitive severity. That or course would be subject to a great deal or arbitrary delineations as well but is a step in the right direction IMO.

"He was only kinda drunk, so the people he killed are only kinda dead, so we outta go easy on him"?

we ate mexican last night and the restaurant was PACKED with families.
i would say of the couples there, probably 10-15 tables contained margarita pitchers, with only 2 adults of age consuming them.
95% of the tables (or more) had some type of alcohol; either beers or margs/drinks.
one might think an undercover cop would only need to sit down & observe for 20 minutes to have a good idea of everyone who had drank over the legal limit.

yep. add to this the fact most people tend to drink at night/weekends when they're probably more likely to have an accident due to it being night and they're more likely to be tired even if sober and you have pitchforks.
most egregoius DUI accidents are obvious and horrific events.
.09 BAC accidents are lumped in as a "DUI" but those don't typically involve the perp going backwards down the interstate at 65mph head-on colliding with a minivan full of nuns.
