The FDA dictates the label and can pull drugs for severe side effects. You’re required to report and warn of any side effects that you know of, and failing to warn usually leads to liability.
No the real loophole is that Generic drugs aren’t liable for a name brand drug’s failure to warn because they’re required to use the name brand drug’s label regardless of whether it’s accurate or not.
So if the name brand company and the generic company know of a side Effect and don’t warn people of it, you can only sue the name brand company.

there efficacy is waning with Delta
these will probably turn into an annual thing, like the flu shot, with the way it mutates and our vaccination rates

That is a good pickup. A lot of what has been going on with the FDA process is determining how they can advertise and what is going to be on the package insert.

We don’t have enough people vaccinated to eradicate it all together like we did with polio. And since it’s a virus, it mutates. That efficacy was pre-Delta variant. Studies are showing that efficacy has waned due to the variant but also due to the time between shots.
I see it as no different than an annual flu shot at this point. That’s just me though. Interestingly enough flu shots have had a lower efficacy than the COVID-19 vaccines. It also helps that the flu is largely seasonal, otherwise we’d probably need more than an annual shot.

The flu sucks for a few days too but no one is freaking out over mass vaxxing for it or cares if people get the flu shot or not.
