No gun, no evidence linking him to the crime, yet you think he is a murderer. Did you bother to read the article?

Your ridiculous questions in OP hinted that you could possibly think he should get off. There is no question he should he prosecuted. And the fact that you asked is why people think you have no perspective.

I was called the dumbest poster on this site by pointing this out. be careful

if anything, the premeditated revenge murder is far worse than the drunken accidental killing. that guy didn't set out that night actively trying to kill 2 kids. the father went out with every intention of killing the man and he did.
Holy Moses please tell me you're joking.

At the same time, his defense hasn't publicly suggested who else might be responsible for Jose Banda's shooting death.
Thats not their job is it?

Are you seriously trying to compare a guy driving drunk and accidentally killing 2 kids with someone that actually sets out on purpose to hurt/abuse a child??
About what and what there. Killing two children from drinking and driving is pretty awful. Maybe a touch less than a pedo, but not much.
Posted on 8/18/14 at 7:56 pm to lsusportsman2
please tell me how a drunk driver actively intends on killing someone.
keyword: actively, implying it was on purpose.
note: actively is not the same as passively, which could describe an accident.

No, I'm saying that I wouldn't convict either of them.
Sure you can.
This man allegedly did. Others have as well.
You can do anything if you can get away with it.
And I'd have a hard time throwing a man in jail for the rest of his life because he killed someone who killed his children.
Now, I also wouldn't be surprised if someone from the executed guy's family decided to exact their own vengeance.
It's a bloody cycle. Nothing new though.

You must be TH03's butt buddy/alter! Glad to have you.

You mean the man whose kids had just been killed and who, I am presuming, was in the truck that his kids were pushing was seen at the scene approaching the driver that just hit and killed his kids? Shocking.

Doesn't link him to shite. I probably have the same box of ammo in my closet right now. Without the gun there is no way to tell if the bullet that killed the driver was fired by the father.
quote:
Investigators never found the weapon, and gunshot residue tests done on Barajas came back negative.
So, where is the evidence that proves to you beyond a reasonable doubt that the father is the one that pulled the trigger and killed the driver?

Guys, TH03 is a legal authority.
He rips OP for pre-maturely passing judgment but he already knows there was premeditation beyond a reasonable doubt. Back off his nuts.

yea, I'm sure it was some random 3rd party who ran up, shot him, then ran off.

I'm not a judge, I don't need that evidence, plus, after reading one article about this, none of us can say anything definite about this.
but...
quote:
Neighbors said they heard gunshots minutes after the crash,
occams razor says:
quote:
Barajas went home, retrieved a gun and went back to the crash site, where he shot Banda in the head.

That's what Blows my mind in this thread... There is nothing to convict him on but gunslinger motive.
I can't imagine this passing a grand jury much less a jury where the defense can be involved with witnesses and their own evidence.

They are no where close to the same. The truck the drunk driver hit had no lights on correct? How do you know that a sober driver may not have hit them also?
Posted on 8/18/14 at 8:05 pm to Tigerlaff
So he had his two kids push his broken down truck down a road going probably 5 miles an hour. And he executes a guy who rear ends them?
How would you feel if the guy who rear ended them was sober? Is it still ok to shoot him in the head?

for all he knew, the driver was sober

Toxicology tests later determined Banda had been driving while intoxicated. But Brazoria County sheriff's investigator Dominick Sanders said that in the moments after the crash, there had been no way to know it was alcohol related.
