I'm not sure to be honest. I know this was a hearing on whether she could start the adoption process or whether the bio mom's rights would be upheld.

Either way, custody has been transferred so I THINK the kids would be staying with the bio mom while things are hashed out. Very unlikely she ever sees them again.

I can say this from experience. When you are a kid in a bad situation, you just want stability. To be damned with what race the person is taking care of you.

Without consent, it becomes a contested adoption, which requires a TPR for the biological parent(s). This triggers due process and a right to counsel. You also run into legal presumptions that favor reunification, which causes all kinds of delays and such.

I'm not familiar with the intricacies of Michigan family court, but I believe that there's a specific amount of time that must pass before you can even apply. Combine that with the fact it was contested. There was a hearing that lasted almost a year. That got overturned. There was another hearing after that with a new judge. Three years doesn't seem like that long a period.

Also, this has almost nothing to do with race. Happens all the time with all races

Also look into threatening to sue the mother for all of the incurred costs of raising the kids. Not in the legal field at all and just pulled that out my arse

Well, the first judge certainly thought and said it did.

But you're right. It happens a lot, but I get the impression black with black and white with white is a commonly held belief in Wayne County.

It's not just that county. Family courts look at what they "interpret" as what's best for the children involved. In a lot of cases, the court sees the "parents" as the best possible environment for the kids. The prospective adoptive mother's views are not considered.

I'm wondering why the birth mother wasn't drug tested, being as that was HER reason for giving the children up for adoption in the first place.

Isn't that illegal as hell? Bio mom could take the money then turn the foster mom in also. Wouldn't be a smart move for adoption mom.
