This is a sad case. I know of several court cases where foster parents were granted complete custody of kids in situations like this. And it was no problem bc the judge was intelligent and actually applied the “best interest of the child” standard.

I hope cases like your OP are the exceptions and not the rule. In some jurisdictions it seems CPS is overly aggressive but then you hear of shite like this.

Disagree 100%. Just because she birthed them doesn’t give her the “right” to them. The other woman is their mother. She feeds them, cares for them, and loves them. They obviously love her too. The bio mom is a stranger. It takes a lot more to be a mother than just spitting out babies.

The movie "Losing Isaiah" covered this more than 20 years ago.

My wife and I foster. Never once has the judged ruled to keep a child in our care verses reunification, even when the biological parent didn't meet the standards laid out by DHR.

It's frustrating. It's also unrealistic to assume that it would go any differently. If you foster you have to prepare yourself emotionally for that outcome.

Our biological kids attend school with one of our former foster kids and she has taken a nose dive since going to live with her family. She was a straight A student and was involved in clubs with us. Now shes getting suspended and in remedial classes. All because her family wanted to get a bigger TANF check (their words) and have a built in babysitter for mom's infant with the third different man.

They system is fricked, but if we can provide any sort of stability and model good family dynamics for our foster kids, I feel like we've done our job.
