So the police are the problem in this case, not the mentally unstable people who want to fornicate on a church altar in front of windows that can be seen from a passerby while they record it? The man who stands in front of a congregation of people and lies every Sunday is not the problem?
I don't care how people get their rocks off in the privacy of a home, but this was not that and this man is a hypocrite. These 3 people can pursue whatever deviant behavior they want in privacy, during their short time on earth, but good luck to them spending the rest of eternity in hell.

The applicable section of obscenity statute (14:106(A)(1)) defines obscenity as exposure of the naughty bits (yes I'm paraphrasing)
"in any public place or place open to the public view"..."which appeals to prurient interest or is patently offensive."
So even though the church was "closed" it's still a public place and was obviously open to public view, as a witness videoed the menage a trois. And yeah, a threesome on an altar is gonna be considered "patently offensive" anywhere in the USA, other than a few select parts of Los Angeles.
