I have a cousin who is an adult living with my uncle. She doesnt pay rent or utilities regularly but does occasionally help with bills. She has become emotionally unstable and at times verbally abusive towards him. She has lived with him most of her adult life. He has discussed her moving out and she has agreed to a time frame but he does not believe she will follow through.
What does he need to do to legally evict her? They live in Louisiana. Thanks for any advice

Does he own the house? Change the locks and tell her to GTFO with a 30 day lead time. That is it.

Can’t help if you live in Louisiana. But if this was in Alabama, you would PIIHB to get her straight and nice again.

Yes he does. So no formal process needed? I know its different state to state. Thanks

Can't speak for LA but in SC if she isn't paying rent regularly she isn't a tenant. Here, he'd have to file a Notice to Quit and get a Writ of Ejectment.

He can probably find a legally binding eviction notice on legalzoom or something, but it should probably be notarized and whatnot. He needs to look into it but if he owns the house he has the full control.

Can he ask her to sign a lease? So next time she misses rent he can start the eviction process?

His wife, her mother passed away recently so he is trying to give her time just to move out on her own but that is an idea.

If she’s not listed on any legal lease he probably doesn’t have to evict her.

Just change the locks when she’s gone, I would think.

If I remember correctly she's there only as long as he allows her to be since there's no contract/lease/etc.

I had a roommate (my name was on the lease) who stopped paying rent. After two weeks (he had quit is job a month earlier) I threw him and his shite out.

Wait until she leaves, change the locks.. Problem solves.

If you don't take extreme action they will keep on doing whatever they want to do.

Nothing pisses me off more than to think someone might try to take advantage of me and at that point I get pissed.. So the only way to put a stop to it is to shut it down immediately.

Sure, his daughter (I assume its your uncle's daughter, you said your cousin and referred to her a she) will be pissed and get upset.. Will probably say some shite she will regret later, but long term he is doing what is best for her. She might need that moment to get her shite together.
