Then that should come to light during the discovery process.

Of course, I mean it wouldn’t be justice without several months of attorney’s fees

So what if you aren't sure and the people who may have information that could lead you to the answer won't give it up when you ask nicely?

Just take their word for it?

That’s retarded. People know their own are frivolous. People just want money.

Wanting money is a tale as old as time, though.

Tell that to the insurance company that just filed suit against the owner of the plane

We really should reign in lawsuit abuse by insurance companies

There are no “normal” plane crashes, they are the result of pilot error, or equipment failure which is usually the result of improper maintenance

I have worked in aviation weather for the FAA for 25 years. One correction to an earlier post: visibility was 1/4 SM as measured by an automated weather observing system. FAA tower did not augment the METAR observation.

Also, the ceiling was not OVC002. Rather it was VV002. Overcast defines a layer 200 feet AGL. vertical visibility VV was 200 feet from ground level into the atmosphere. VV is the highest level you can see into the sky when Dense fog FG is present. Distinct difference.

The plane crashed!
And? Are there no reasons for a plane to crash besides negligence? Pilot has a stroke? Sudden shearing winds?

It’s not profit. It’s called damages and making someone whole.

Read a book about how a civil law system works before you attempt to engage in relevant discussions on the topic.

While you’re at it, read a book on business and learn what the word profit means.

You really think he is “profiting” off his wife’s death. You’re just as jaded as the serial killer. That or you’re a money hungry cheapskate.

Out of the group of attorneys that are in this thread, I am really hoping you aren’t one. You are unhinged.

Of course there could be different reasons. Why are you avoiding the obvious visibility issues that a million people in south Louisiana could testify to and is clear from all documented weather data from the day? No, let’s come up with some real BS and say the pilot had a stroke.

Ahh, you mean the one you wouldn’t want to go against in the courtroom? I’ll take that every day of the week pip-squeak.

Im not. I don't recall all of the details of the event. An earlier poster said it was weather that remained within the parameters for the aircraft. Was it not?

You really wouldn’t have any mental suffering being distraught over losing your young wife whom you envisioned have beautiful children with. If not, you’re probably a psycho and possibly a serial killer.

First, you either live long enough to see all of your loved ones die or else you are the object of loved ones' grief. So it goes.

Second, grieving and going after someone legally due to your grief are two very different things. I'm not saying that you should never sue for mental anguish or wrongful death. But it is also true that money is literally no substitute for a life. It's nearly a non sequitur without very specific, fitting uses/purposes for money-damages award. .

Yeah, right. Except until it affects me! Then I want the best lawyer to sue em for everything they got!

I am confused why there is push back in this thread. The husband files a negligence claim, if the FAA finds negligence he gets the insurance and damages. If they don’t, he should get the insurance claim. Or have to sue the insurance company separately. Right? Seems pretty standard unless I am missing something here?
