Yes, your are correct. I meant to say “defamation”. The correct term for what he did would be considered libel, not slander, both of which are defamation.

And I wouldn’t need an attorney, I could file pro se if I truly gave a frick. I’m sure his mommy and daddy would settle regardless.

It all depends on jurisdiction and your lawyer.

I know a guy who got 1 & 2 on the east coast, then 3, 4, and 5 within 6 months out west. Because of his lawyer he was able to get them to ring the 3 up as 1 and he had to have an interlock device on his car for 3 years.

A year after it was removed he got a 6th DUI in another state and he lost his license for 3 months.

Spent around 10 days in jail for the 3,4,5.

Spent around $20k in lawyer fees for all of them.

If all of the DUIs were in the same state then the penalties would have likely been worse. He would probably be in prison for 5 years and have a permanently revoked license.

I'll say this. One of my best friends was arrested for DUI on at least 4 occasions that I know of. Guilty each time the 4th time was listed as a first offense. He had a breathalyzer in his car for years... I don't understand it. He eventually somewhat turned his life around. Got a great job for a big company in the DFW area for a period of 10 years was doing well with wife and kids. Eventually started heavy drinking again. Lost his family over it. Divorce. 2 years later found dead on the floor from overdose.

Don't drink and drive.

1st offense - 90 days in jail, lose license for 1 year
2nd offense - 1 year in jail, lose license for 5 years
3rd offense - rot in jail
