Drunk driving is wrong and there are easy alternatives. That being said, I would love to see some real statistics on it. Things like how many arrests are from repeat offenders? How many offenders have a prior criminal record? Prior history of traffic violations? How does it cut across demographics or level of education. (I doubt it discriminates). I would be curious to see how that plays out. I don't think any statistical group would be immune to it, but it would be interesting to see how it trended.

I never understood why there isn't a different level of DUI for severity. I understand driving impaired is something no one should ever do. However, why does someone get the same dui for a blowing .08 has the a-hole blowing a .3?

A lawyer I know once said a drunk driver is like a serial killer in the sense that they are a threat to kill any random person at any time without any motive or warning. Kinda scary because it's kinda true.

Cell phone drivers are actually worse based on study results. Which is why as a certified drunk driver i hate the idiots in this thread that will bitch about drunk drivers all day but are constantly driving and texting terribly.
I guess i should clarify i got a dwi 9 years ago and didnt hurt anyone besides my wallet. I dont do it anymore but i would hate to think im the scum of the earth for cruising empty roads drunk and getting pulled over and paying $6k and having a suspended license for 9 months

No. For first degree murder, you have to have specific intent AND one of the specified aggravating factors. Certain enumerated felonies, but not just any felony, can fulfill that requirement. The felony murder doctrine which allows a murder charge for any death that occurs during the commission of a felony applies to second degree murder, not first degree.

Louisiana has Vehicular Homicide. I think they used to charge them with manslaughter. I think it carried a maximum of 21 years at hard labor. Back in the 1990s, I watched the sentencing in one egregious case where a drunk driver barreled through a red light and killed two ladies in Concordia Parish. He got 21 years on each count, to be served consecutively, but it was clear the judge would have given him more if he could have.

When I was growing up in the fifties and sixties, on!y squares did not drink alcohol and smoke cigarettes
American culture reveled in and glorified alcohol and cigarettes,that is how I was raised.
Remember the Matt Helm movies starring Dean Martin where he would push a button on the dash of his convertible thunderbird and a cocktail shaker or chilled bottle ofchampagne popped up out ofthe center console?
Next day, no longer acceptable.
Bars and restaurants like Bennigans were offering 2 for 1 cocktails 12 hours a day while MADD is on the editorial page.
I'm just sayin
The technology exists today to sample drivers blood everytime they touch the steering wheel which,teamed with an interlock device can solve this problem!

If legislators or the auto industry cared, every car would have some sort of breathalyzer test to start it. Luckily self driving cars are coming sooner rather than later.

I was at an intersection where a guy ran a red light while drag racing and he was intoxicated.
He got out and started screaming "My baby! My baby!". The guy had his infant in the car and he/she was killed after being smashed between the door and the seat.
