I’m fairness to him, he was a Federal Election Commission guy. That said, it is odd that a district judge nominee had never heard of Daubert.

Holly Thomas didn't know what the Erie doctrine was when Kennedy asked her about it at her confirmation hearing. She's now on the 9th Circuit Court of Appeals. The Erie doctrine is one of the first things you learn in federal civil procedure in 1L year of law school--federal courts apply the law of the forum state when the basis for federal jurisdiction is diversity of citizenship (i.e. a lawsuit brought by a citizen of one state against a citizen of a different state, where the amount in controversy exceeds $75k).

No lawyer is supposed to know every detail of the law and Constitution off the top of his head in any occasion.

BUT, every lawyer is supposed to know the pertinent law for the occasion where he has to perform.

Nowadays, when you’re sitting for confirmation to the federal bench, you should have probably freshened up on the Constitution beforehand.

7 simple articles, you would think she would be able to retain that information. Apparently that’s too much to ask

She also had no idea what he was talking about when he asked her about purposive interpretation of the law. These are very simple concepts for anyone who paid attention in high school

I was in the car during a private discussion discussing the nominations of a high level state judge

The basics were the vas majority of the people they considered were wildly unqualified. Like people couldn’t even answer a single case

Bingo. I don't care if they are republican nominees or democrat nominees. They must have more than a basic working knowledge of the law and the function of the federal courts.

Trump nominated a bunch of idiots. From the video, it is apparent that Biden may have nominated an idiot as well.

Ok, in fairness to the nominee, I could not have told you off hand what Article V was. I could have told you I, II, and III.

And who in the hell knows what "purposivism" is? That was a cheap shot as far as I am concerned.
