Assuming this is on a vehicle/boat?! I have Agreed Upon Value coverage on my vehicles/boat, especially with the crazy vivid pricing. Thankfully haven’t had to go through this process

Just ask them about it. They try to make it awkward and don’t usually offer it for free. When you ask, they should process that claim and make you an offer.

Only if they deny it, or you are unhappy with their offer, then consult an attorney. However, be aware they are pretty difficult to prove and get an exact value. If the offer is reasonable, take it.

Their insurance and I should have been more clear in my op. It is for a vehicle that was rear ended.

You are unlikely to have anything more than minimal success on your own.

The marginal difference for an attorney to take it and get a fee also is unlikely to give your satisfaction.

If you have a Ferrari , Lamborghini, 911, Bugatti, etc. that calculus may shift. If it’s a car similar to those mentioned above many attorneys may entertain your prospective DV claim.
Without knowing anything regarding your prospective claim, I can only suggest you visit the dealer and ask for a written opinion re: prev. vs. post MVA value.Unfortunately, many dealers are reluctant to render such an opinion.

I tried filing one myself and the insurance company low balled me. I argued with comparable Carfax values and they wouldn’t budge. I ended up calling this service. I can’t remember who it was but they were from Louisiana. Not Baton Rouge, down I12 someplace. I want to say I paid them $200-$300 and they put together a packet of information and sent it to the insurance company. Suddenly the diminished value went from $2k to $6k, which was appropriate.

File and see what they say and go from there.

If they are jerks then there are a million lawyers that will help you with arranging doctors visits and medical claims.

In LA, diminished value claims typically require an expert opinion and $200-$300 would be a comparable price.

It was Collision Safety Consultants of Louisiana. Looks like rates went up but it’s been like 5 years.

I got an attorney. They were not gonna pay me and told me they had closed my file.

I was entitled to $1000...I eventually got it but not until they were served.

I told they Lawyer to sue them for $50,000 and if he wins he could take his family to Disney and keep the other $49,000...I just wanted the $1000.

I had one recently. I just told their insurer I intended to pursue it and they came back with a reasonable offer. I took it. I drive my vehicles until they fall apart so I’m never expecting much value at the end of their life anyway.

This is the email of the guy who did my claim...I don't know if he still does it or if he is even alive but I remember him being reasonable.

I’m in the middle of a DV claim with progressive after their client rear ended my 2 day old car. I had an independent appraisal done and sent it and they low-balled me by 70% of the appraisal.
I’ve gone back & forth and even sent actual CarMax offers for my vehicle with and without damage record showing a difference close to the appraisal.
They scoffed and offered another $100…
I’m still debating options so I’m following this thread for ideas….

50% of the repair estimate with supplemental charges isn’t out of the question. Most experienced/qualified attorneys will ask for it…
