Am I the only 1 that doesn't find that surprising at all?
make that decision as late as possible to see if his testimony is needed
ETA: weigh the risk/reward of putting the defendant on the stand at the moment it's time to put that person on the stand

Chauvin is invoking his 5th amendment privilege - likely means Nelson believes their defense is strong enough without his testimony.

I know we have closing arguments to be made, but typically how does the deliberation work?
What I am asking is if there are jurors who go one way or another and they can't get to unanimous decision either way, how long do they go for? Like who makes the decision or when is the decision made they cannot come to an agreement?
Also wtf is this newly discovered evidence?

the State is arguing that Dr. Fowler's testimony uncovered new carbon monoxide evidence that lead their expert to re-examine Floyd's blood testing from May 25, 2020.
State argues that Dr. Baker unilaterally sought the blood work information following Dr. Fowler's testimony - that the State didn't seek this information out even though they subpoenaed all records from Hennapin County Medical Center.
Judge is deciding if said evidence was actually new and not just glossed over.
EDIT - this is outside of the jury, they have yet to be called back in.
EDIT 2 - Judge asked State about report from Dr. Fowler produced to them in February that stated that testing of Floyd's blood for carbon monoxide should have been done or should still be completed. Ie. State could have discovered this information back in February.
Nelson rebutted that he received these test results on the blood at just before 8 am this morning. This issue was raised on Feb 22nd - State has had sufficient notice that Dr. Fowler was opining that carbon monoxide could have played a role. That State could have rebutted any suggestion of its role upon receiving Fowler's report and its references to carbon monoxide therein. Fowler's testimony is finished and he is flying home. Admitting this rebuttal information is overly prejudicial (which it is).
Nelson also received Tobin's rebuttal points last night, 3 of 4 points are improper rebuttals. State is attempting to reintroduce Dr. Tobin's prior testimony - ie. its not a different, or rebuttal opinion, just cumulative.

The judge has already stated that the jury will be free on the weekend, with closing on Monday. He told them to pack a bag when coming Monday morning because they will be sequestered for deliberation.

They're arguing over a monoxide test seemingly the prosecution glossed over. They had a chance to get this study and didnt until their own witness reached out yesterday they had a study that proved otherwise.
ETA: Seems like a pretty big oversight if the judge disallows the evidence. The prosecution has treated this trial like the burden of proof is on the defense up until this point this morning. They have not ruled out the other ways GF could of died.

I think he may be leaning to the side of exclusion, based on his comments so far, but we will see how strong he is.
