The judge. In federal court it is the Daubert standard. Many states follow it.

I get that. I would certainly say there have been some very positive moments for prosecution. Remember the charges, this doesn’t have to be that Chauvin intentionally murdered GF. In fact, none of the charges allude to that.
The most likely right now is second degree manslaughter, as the proof needs to be DC was creating “an unreasonable risk” and “consciously took chances of causing death or great bodily harm to another.”

Honestly wouldn’t appease either side.

Would not be enough for people that want him to fry.

Would feel like the jury was just picking something, to those that feel he should walk free and not have been charged

I personally think his testimony is too technical. A person with average intelligence and no medical background is going to grasp less than half of this.

To be expected. Seems like he is very credentialized and that is being attacked by an attorney that is not an expert. He also has no experience in trials and comes from another country. I think he’s holding up well considering.

Nelson should probably wrap this up....I think he’s trailing here and don’t know he can get the moment he wants out of this guy.

Got him to admit that things shift and the exact amount of pressure by DC couldn’t be calculated by video and pictures

2nd degree manslaughter is indeed where this is headed.

The state's case suuuuuucks. The jury will feel compelled via social and media pressure to convict on something but they know there's no way DC is guilty of either murder charge so they'll settle on manslaughter.

And manslaughter, if you read the charge, sounds plausible if you're a juror in this case.

But we haven't seen the defense yet. It could get really bad for the state considering how seemingly half their witnesses seem like defense witnesses.

It'll either be guilty on 2nd man or not guilty on all with a pretty good chance or riots no matter what.

I think he meant in present time. Aka there are 10% of people with COPD that still smoke as an example.
