I'm serious, all the guys arguing she could consent should think, if you were as drunk as her and some woman wanted to sodomize you with a 9 inch dildo and she asks you 5 times after you slumped over in a drunken stupor can she sodomize you, dry with no lube? Keep in mind, you consented. But your BAC is .319. What if your son consented to that while he was drunk as Madison to the point he has anal injuries?

I think when people say “they were all drunk, it’s nobody’s fault”, they are ignoring the biology and physics of the situation. When you sodomize someone, you have to be an active participant. When you are sodomized, you can literally be a corpse. This is true even if both participants are male. The sodomizer has more responsibility in the situation, all things being equal.

You know, I think everyone knows that. But those like JLSU are being purposely obtuse. If he had a BAC level of. 319 and someone wanted to sodomize him with a dildo and he gave consent under the same circumstances that Madison gave "consent" he would feel alot differently. But by his logic, we should shrug our shoulders and say "well it was drunken sex"

No victim no crime. If he doesn't press charges, then no. If he does and it was under the same circumstances we have in this case, yes. Since the victim is deceased and thus can't do anything, the state is moving forward on her behalf.

It’s the stupidity of the law that only a woman can be raped, and there’s no wiggle room in the law. If you’re a woman, you’re over .08, you engage in sex, then you were raped.

Well it sucks to be Kaivon and Desmond right about now. I'm sure they were loving their lot in life when they were taking turns sodomizing Madison in the back seat. Although I'm sure now they wish they never met her.
