To be honest, no. The whole point is she was too drunk to consent. Just like someone can be too young to consent, someone can also be too intoxicated to consent according to the law. In both cases, it doesn't matter what they say.

It really is. Either she was intoxicated and thus not able to consent or she was sober and could consent.

And if they’re all intoxicated?… then what?

All obligation on the male?

What if the sky was pink and I could fly around like Superman?

What if I could shoot laser beams out of my eyes like Cyclops?

What if you stop asking what if questions that have nothing to do with the case? What if you did that?

Well so far, the bond judge, the state of Louisiana and the grand jury all agree she was too drunk to consent. And, the way its looking, a trial jury will also agree. Although, I suspect that Desmond and Kaivon cop plea deals to avoid trial.

I’m not being fantastical….cmon, they were all at a bar, If you have been as well you know that was a drunken car.

We’ve all been there

IMO people all worked up over the fact that she died, which has NOTHINIG to do with what happened in that car.

If you initiate sex with a drunk girl, then yes, the legal burden is yours.

If you're passed out and barely coherent and she asks you for consent to stick a bowling pin up your butt and your BAC level is .31 and she's sober enough to ask you for consent 5 times AFTER you slumped over and couldn't tell your address and she sodomizes you with said bowling pin, then we will all agree that she raped you.

Because I have a feeling that you would view it differently if a pretty blonde girl stuck something up your butt while you were drunk at out of your mind at a .31 level than if she pulled your penis out and started sucking it.

What if the drunk male is your son?

(Oh BTW your quote above is NOT the law, nor should it be)

Drunk females are more important than drunk males?

Do you think the driver left out them being drunk to avoid charges related to that? Drunken driving, giving alcohol to minors, etc?

Not so sure about that

Driver says “get her out, get her out” of the car

She gets out and is hit in the middle of the road soon after and dies

If the males were also drunk then it does have something to do with the case. However we don’t have the liberty of knowing their BAC

Obviously I have a emotional connection to my son, that's why I wouldn't be allowed to be on the jury. I can just as easily say, what if your daughter or your mom was in Madisons position. I guarantee you that you would be talking different

is this where we get to say something stupid like “if my aunt had nuts, she’d be my uncle” as our response to your statement, like you did previously?

The part you can’t understand is that some of us don’t agree that the law here is black or white, as so many of you here view it.

So you’re saying it wouldn’t be rape if she started sucking his dick?

Where did you find that sex was consensual?

Regardless of the fact and law that states that she was too drunk to consent.
