Do you think he goes to trial or do you think he offers to plead to 3rd degree rape in exchange for dismissing the 1st degree rape charge? I don't think he'd want to gamble with being convicted of a 1st degree rape and doing life. 3rd degree is up to 25 years. If he pled to 3rd degree rape, it's unlikely he'd do the full 25 unless perhaps he got into further trouble while incarcerated.
Honestly, I suspect that if he did plead to 3rd degree rape, he'd do about 5 years, 10 at most. Being 17, he'd be 22-27 upon release. Still a young man. And he'd likely have to register as a sex offender. But that's a much better deal than life imprisonment and at 17, assuming he dies naturally, that could mean the next 60+ years.

Sounds like she wants to go to jail to.
Maybe she can get up with her brothers attorneys and they can submit some of her threatening FB post to the DA to help prosecute herself.

Unless the prosecution has way more damning evidence that the public is unaware of, I don’t see how they can convict 1st degree rape.

You think the NAACP are trying to distance themselves from this, especially after the other defendant they went to bat for, Kaivon Washington, ended up being charged with 2 additional rapes?
Do we know that the NAACP did that for Washington? I remember seeing speculation on this. I don’t know that I saw anything firm.

First degree Rape
So it's first degree under the law.
Remember two rapes - the 17 y.o. and then 18 y.o. (Washington).
First degree as an adult carries a life sentence.
I wonder which defendant is up next?
I expect it to be the 28 y.o.
Oh, did anyone spot Casen at the courthouse? The press? Curious if he 'flipped' and testified.

Can someone translate this for me?

Glad that dumbass defense attorney bloviated about this being consensual right at the outset. Ineffective assistance seems like an understatement now.
Haley represents Washington, not the juvenile, right?

I read an article that the NAACP was paying for Washington's lawyer. Perhaps I'm wrong on that.

Washington had the phone making the video the defense lawyers handed over.
Madison - blurred out and go re-watch - was pulling up her pants as she exited the vehicle.
So we have this felony in the video the defense lawyers shared with the world.
They gave Nakamoto proof of a felony, which he then put in the news story.
quote:
(3) Whoever commits the crime of video voyeurism when the observing, viewing, photographing, filming, or videotaping is of any vaginal or anal sexual intercourse, actual or simulated sexual intercourse, masturbation, any portion of the female breast below the top of the areola or of any portion of the pubic hair, anus, cleft of the buttocks, vulva, or genitals shall be fined not more than ten thousand dollars and be imprisoned at hard labor for not less than one year or more than five years, without benefit of parole, probation, or suspension of sentence.
TITLE 14 - Criminal Law
RS 14:283 - Video voyeurism; penalties

Not for a juvenile. Everything requires indictment to charge as adult.
I think this is right. And IIRC, you only have 30 days after arrest to seek it if the juvenile is in custody.

Why'd the start with the 17 y.o.?
There are some 30 day deadlines for charging juveniles. Orleans just blew the deadline in another high profile case.

If you are in the area preparing a podcast or story, go to 1:19 of this story and look outside the front windshield.
This is NOT Pelican Lakes. Across the street is a wooden fence - one-story house neighborhood.
Any idea where this is? Trying to figure out how Madison got from there to where she was struck.

They got out after the sex and switched right?
Posted on 2/22/23 at 11:12 pm to JudgeHolden
Knowing what you know about these cases, how do you see things progressing from here?
That the grand jury charged the 17 YO as an adult and 1st deg rape, what's the significance of that now?

They got out and switched (according to their story in the Affidavit) but this was getting out to let Madison exit, "Get out! Get out!"
I think that video may have been made in one place. Then she realized she didn't have a phone to Uber. So they let her back in the vehicle.
But that's why figuring out what's in that brief image matters.
More lies the perps tell = less believable when they say anything else.
That looks like a sideways street sign (speed limit?) as you see the truck drive by. The building across the street has a white top. I don't think anything within two miles down Burbank has that.
Again, how did Madison get to where she was killed?
The closer in time and location her drop off was to where she was run over = more likely it would be negligent homicide or even manslaughter. That's based on the 'legal eagle' commentary on here.

That looks like the front of Reggie’s and a white tent.
Posted on 2/23/23 at 1:11 am to TigersSEC2010
If it's Reggie's, they raped her around the corner (according to affidavit) and then brought her back to Reggie's?
My theory: they dump her out of the car. She looks and realize she has no phone. She waved them down, apologizes to Casen and she gets back in the vehicle. This was not the 'exit the vehicle - we drive off' video.
It was (and maybe I've been around too many sloppy drunks) the "dump out of vehicle when aggravated only to let them back in and the drunk babysitting continues" moment.
Judge,
Your time of night...
