O think a lot of people assume that. I don’t think we know that.
Given the audio not matching the video and the video was "edited" by admission of Nak, we know there's more video.
How much more, yes, is unknown.
I believe one or both rapes were recorded - at least in part. But they later tried to delete the video. Will find out.
Who can attend the grand jury proceeding?
What do you think odds are the negligent homicide or manslaughter charges will be included?
Like you, I thought that case was weak at first but "SECONDS LATER" - what the family attorney said - she was run over?
It also looks from the video that she was kicked out of the vehicle rather than demanded to be let out.

Having her on video antagonizing him for not wanting to have sex with her is going to be a hard sell for the prosecution against him with a jury
This prosecution is dangerously close to frivolous IMO. I will not go into more detail than that, out of respect, but the authorities are not doing anyone involved any favors with this spectacle. At the absolute worst, these defendants should have been allowed to plead and get probation.

You do understand .319 BAC = LACKS CAPACITY TO CONSENT.
Doesn't matter what she says on the video.
She's not capable of consenting to sex.
The perps should be charged with first degree rape and manslaughter.
You a relative?

Is this black-letter law somewhere that I’m missing?

From memory . . . .
Grand jurors.
Prosecutors.
Court staff needed.
Witnesses when they testify.
Grand jury proceedings are secret.
I think the only reason they would present it to the grand jury is to charge them with first degree rape, which carries a life sentence.

It is not.

Nak and WBRZ wanted the "exclusive" so they became the mouthpiece for the defense and aired a heavily edited video. Even that, according to the Judge in the case, showed Madison was severely intoxicated. Not sure where they got the audio but it appears (1) Madison is being kicked out of the car for offending the driver (2) "Uber" is mentioned by her but, according to another poster 'in the know' Madison did NOT have her phone as she left it back at the bar. So they raped then dumped a severely intoxicated girl a mile from Gardere Lane at 3 a.m. in the morning with no phone not having a clue what she would do. She was 'in the roadway' on Burbank 'second later' (according to the family attorney) where she was struck and later died from her injuries.
Wonder if this attempt by the defense actually makes the driver more in play now with her death?
He definitely says “take her out, take her out” of the car

By the way, Nak is a POS for playing along with these lawyers.
Yes, when he was younger he was good at what he did, but over his career he has really morphed into quite the slime ball.
ETA: Hey Chris, I see you’re reading the OT for hot news tips now. Slime ball!

Curious how he knows this. Has it been established when and where she left the vehicle?

For sure he says that to her. Did they verify she had a phone? She didn't know her address but she couldn't open a maps app and see where she'd been? The "uber" comment seems edited into the video shared but when did she say it? What was the context?
Judge,
The "publicity" allow a lawyer to selectively edit a video to mislead the public?
Do you think Casen's lawyer not being there means he has now "flipped"?

Presumably the video is timestamped. They know when she was hit.

2:50 is when the Burbank accident was called in.
Video has something called "Metadata" on it - as do photos.
They tell when the video was created and, in some cases, where.
It's why you shouldn't share pics of your kids or grandkids on social media. You're basically handing the home address to random perverts on the web.
Also, NOTHING is ever 'erased' from a device. Can be cracked and recovered and there are also auto iCloud and similar backups.
Once police are legally 'inside' a phone, any other crimes on there can lead to other charges.
Sort of like if they got a warrant to enter a house for drugs but found drugs or other crimes = more charges.

I don't criticize that.
What I do criticize is ineffectiveness. I think the press conferences are ineffective at best and harmful at worst.

Imagine allowing the defense to victim blame on your newscast multiple times.
Posted on 2/14/23 at 9:37 am to DVA Tailgater
Nak and WBRZ wanted the "exclusive story" and the video.
All about clicks and attention for them.
In fairness, Nak did mention her BACK was .319 and did play video from the statement made by the family attorney.
But notice not much pushback during the interview: No statement like, "We asked to see the full and unedited video and defense attorneys refused..."
He wants to keep getting 'scoops' out of them.
I agree with "Judge Holden" and the Judge in the case: the video shows she was severely intoxicated.

I would not draw that conclusion at this point.

A big part of persuasion is selecting facts to emphasize.
And you don't really know that it is "misleading" without seeing the rest. You also don't know that it is the lawyer who edited the video.

He reported a story in which both sides (all sides, really) were allowed to comment. To me, that is what reporters do.
I thought his comment about the grand jury came off a little odd. More in another post.
