The detective will say it was five for one based on what the accused said. The accused would then have to take the stand to rebut it. I doubt these kids would do well under cross.

I’ll try to be nice.

Their perception of her drunkenness is an element of the crime.. The chances of those statements being stricken because they aren’t “experts” is extremely low.

Apparent drunkenness is a pretty standard example of permissible lay opinion even if it were not, and I can’t emphasize this enough, an element of the crime.

Call me a detective but perhaps she intended on going to her friends house in pelican lakes to stay the night, and didn’t know the exact address. She was likely too drunk to tell the driver turn for turn where to go so eventually she said take me back to my sorority house and they were like we’ve been doing this for forever so she was like fine I’ll get an Uber and they let her out. Once again call me crazy but that’s how it sounds

While simultaneously saying that the only medical expert who determined her BAC was wrong and had faulty equipment.

I would love to see their lawyer make that argument and get thoroughly embarrassed.

Well. You’d make that in front of the judge on a limine, not in front of the jury. Judges understand alternative positions.

Could any parent here watch the cell phone footage, from the car, if Madi was their daughter? I can't imagine having to see that.

Oddly, this could benefit the accused. The DA will probably give them a better deal to spare the family IF the family wants that.

There are 3 possibilities -

She was passed out
She was blackout drunk and "enjoyed it" (real or otherwise)
It was a violent act

None of those are something a parent wants to see.
