i'm worried about the defendant's statements somehow someway getting thrown out based on some technicality.
Thought about this.
The detective who took them seems pretty experienced, and he says he Mirandized them. Remember, too, that they both came in voluntarily. I think that part of the case looks ok.

I don’t even need to wait for the jury to be picked this time. It’s already a public racial spectacle. Do you want to make a one-year ban bet?
frick a ban, but up some money.

This is all bullshite by the defense side. They are trying to create a narrative in the court of public opinion and get to the potential jury pool.
It's a bold strategy. That is for sure.
I did have to laugh at a lawyer holding a press conference this early in a case while declaring "we don't want to try this case in the media!"

They also seem to be saying that the post-sex video shows her to be coherent enough to consent.
As an attorney, i'd argue her inability to not get run over by car on a dark near empty road 4 minutes later says otherwise.

Did of the boys come in and give statements with their atty present at the time? Originally? Or just they went alone to speak with detectives.

I think they are saying there is video of her getting out of the car and looking just fine.

I don't think they had an attorney present.
If I remember right, Washington asked for a lawyer when they wanted to swab him.

Can the prosecution request a change of venue or is that only the defense?

One thing I noticed is:
-She asked for a ride.
-She asked to be dropped off at a sorority sister's house which is where they were bringing her.
-She exited the vehicle in good condition because she wanted to catch an Uber.
They left something out there.

I got that. I was saying as the prosecutor i'd come back with the above response.

Either.
Louisiana Code of Criminal Procedure article 621:
quote:
A motion for a change of venue may be filed by either the state or the defendant.

Pretty sure he said sorority sister's house. But maybe I'm wrong.
