Why are you forcing this hypothetical into the conversation?

No one cares to wonder what would happen if they didn’t talk. The driver was going to flip on these guys at some point anyway to save his own arse.

Read the law again. People having sex drunk isn’t illegal. So, they can’t be like I was drunk too so I’m actually the victim. The question isn’t was the victim drunk. The question is…was
the victim incapable of resisting or of understanding the nature of the act (because of alcohol or other substances). So it’s not just drunk. There is absolutely no evidence here that the perpetrators were “incapable of resisting” or didn’t understand the nature of the act. Quite the contrary…

It wouldn't be a slam dunk, but the cops and DA could easily put together a narrative that the only people who could have possibly raped her were one or more of those 4 men. Lean on them until one cracks (the one's that didn't actually do it).


Outside of not raping her the only thing that would have helped them is getting her home alive. Small chance she doesn’t report it in first place, but even a bigger chance she does it after blood alcohol test doesn’t shows anything or is even taken making how drunk she was her word against theirs with only bar videos and other people drinking to help either side. Possibly also after showering away some evidence making it easier to cloud who did what.

Easier to make others believe enough for reasonable doubt that she was drunk but coherent and understood situation and that losing balance and stumbling was those 2 goofing off and flirting on way to car if they hadn’t left her on side the road to get run over in middle of the night, have BAC immediately taken, dna if any not washed away, and then die from those injuries.

Being killed doesn’t change whether at least 3rd degree rape was committed, but in this case it helped completely prove how drunk she was and left a dead body requiring state to seek justice versus a 19 year old college girl that might decide a plea bargain with minimal punishment or even that dropping everything is better than this all coming out in court in a she said/he said case over legal consent (or even assault if delay in reporting minimizes any proof that can be collected).

They have person after person contacting them that they were raped by Kavion Washington in past

At least 3 stories
2 charges of rape have previously been filed against him

At least 2 willing to come forward

Can skip over first 8 minutes of the podcast

That and:

1. They are are on video walking around normally
2. Driving
3. Other witnesses could come forward and testify that they were sober, rapey, creepy (and still might)

So do their own words sink them? Yes? Do they get off without them? I’m not entirely convinced.

Wat? That's not what black out means to anyone I know. It means you drank so much you don't remember the night before past a certain point in time.

The black out is referring to your memory and had nothing to do with sleeping. Many function okay when blacked out.

Sounds like someone who knew he shouldn’t be having sex with that girl before, during, and after he was having sex with that girl.

Not only have I said they are evil and guilty of rape, I have said them being absolutely ducking dumb as a box of rocks is what made the case against themselves
