Well eventually everyone born before Sept 1 1969 will die and then it will technically be mandatory. I think that's how a lot of these kind of laws get passed.

Let’s say a boat captain is traveling from point A to point B at midnight traveling approx. 52mph through obstacles going into a river and passing a boat. If nothing happens. Some would say he was a good driver and some would say just lucky.

So let’s look at this in a different scenario

If a boat captain is traveling from point A to point B at midnight traveling approx. 52mph almost hits trees, blows through a No Wake Zone, almost hits trees again and then collides with another boat. Kills people and injures people.


Let’s put a twist in that scenario. The Captain isn’t even behind the wheel.

Not even including Alcohol

Would this be negligent, irresponsible, stupidity, a moron, or all of the above or something worse


Again This is just made up scenarios and trying to get some opinions

Hitting another vessel is a violation of maritime law. Lawyers will argue who was the 'stand on' vessel, etc. There are no speed laws other than violating no wake speeds. Inland waterways might be a little different but the collision itself proves a violation by one of the operators. 50 mph at night in a possibly crowded area is negligent in itself.

The boat owner is not a licensed boat captain, none of which I know would be stupid enough to run the Tickfaw at night at 52 mph.

In fact, a licensed captain would likely not run the Tickfaw at 52 mph in daylight, especially with paying passengers aboard.

Your hypothetical is convoluted, but from what little we know he was grossly negligent regardless of how you classify him, assuming he was piloting the vessel at the time of the accident.

Doesn't matter. If it's his boat and he's on it he's the Captain and responsible for anything and everything that happens on it.

Nonetheless, a tragic occurrence for all involved. especially the families who lost their loved ones.

Maybe. All I know is when I lived on the TN everyone said you can’t boat at night. Those that did were very sneaky about it.
