If you are neither his manager nor his HR representative, then you need to stop gossiping and mind your own business. You don't know what could be going on with him and he's probably stressed about missing work.

Tell him to sign up here and post non-stop while he is off.

You could be out looking for a rental property to buy, instead of here bitching like a little twat.

if he's not breaking the rules that the company has set up, why is this any concern of yours?

We're also a big (law) firm. And HR got involved because my boss asked how they needed to code my time out of the office. Turns out we didn't need to code anything, but once they found out why I was going to be out, I got the request for the memo and stipulations when I could come back. Idea being that if I came back to work earlier than my doctor allowed and I hurt my neck, the firm could be liable.

And it's not that I wanted to stay home that long. I was going batshit crazy after only a week.

Ah gotcha

But yea, I understand whatcha mean.

But not really

Don't give that much PTO then if you didn't want someone to use it in a situation like this so they can take their time to recover from surgery

It's not literally his business. OP has no authority to determine anyone's PTO.

Have you asked him if he’d consider taking 3-4 weeks of PTO (no working) and then work from home the remaining 2-3 weeks and be able to stash the PTO for those weeks?

He pretty much explicitly stated he will not be doing the same.

Well, he'll get credit for hours worked when he's working remotely, right?

I know I did. I wasn't putting in full days because I did have to go to PT and doctor follow ups, but I kept a log of work I was doing and times I was working so I could track work hours vs. sick leave hours.

If I wasn't getting compensated, then I would have been far less likely to log in.

He's using mostly paternity leave.

No it ain’t frickhead. Not everyone responds to surgery the same way. Age plays a factor. Pain tolerance. The kind of graft used for the ACL repair. Surgeon doing it.

Health is this country needs to be taken more seriously. He sounds smart.

He didn't because he isn't HR or the dude's boss. He is a co-worker who can't mind his own business and is complaining about a little extra work.

If he's using paternity leave, then that tells me he didn't use it (or use all of it) when the baby was actually born. Which means he tried to get back to work as soon as he could.

Look, I believe PTO is meant to be taken as well. If his reason for leave qualifies, then so be it.

It will suck for you and your co-workers to be short, but these types of things tend to happen to everyone eventually. Even you, the great Mingo, will at some point need an extended stretch of time off from work.

As far as him not checking e-mails, I know in some companies, if you are on certain types of PTO, you are FORBIDDEN from doing this.

The guy is probably going to be on painkillers for around 4 weeks and it could be longer. There is liability for someone on painkillers performing job duties. It is highly inconvenient for coworkers, but it is going to suck massively for him. Luckily, he has the leave. Six weeks is about the standard recovery time to return to work. Some go back sooner, but every recovery is different. Have some sympathy... he’s going to be in pain for months and have quite a few medical bills. This should not affect his career unless he is getting drafted next season.

If anyone else has had a bad leg injury, it’s a pain in the arse. I broke my ankle a couple years ago and needed surgery.

You can’t use that leg and have to use crutches everywhere. It’s a pain in the arse just to sit on the toilet when you only have 1 good leg. It’s not easy to wipe your arse either. And taking a shower is a bitch too.

You are also supposed to elevate your leg above your heart for a lot of the day and ice it several times a day.

Any time you get up out of bed and put your leg down, all of the swelling pools back up into your ankle and foot, and it’s incredibly uncomfortable.

Obviously you can’t drive. At least I couldn’t since it was my right leg.

Six weeks out of the office doesn’t sound unreasonable. It was like 10 weeks before I could even start to put weight on it I think. And then even once you’re able to put weight on it, you can’t walk yet. Everything is so weak and tight. You need physical therapy and exercise to be able to walk again, which may take another 6 weeks.

Now could he work from home? Probably.

doesn't sound like they have much of a "team" at all. Dude's out having surgery and one of his "teammates"' first reaction is to whine on a message board about having to do a little more work.

Considering he does it already, yes he can. That's all I'm asking and don't feel it's unreasonable. Take 2 weeks to recover if that's what you need, but it's pretty shitty to not be available for 6 weeks in my opinion. He can lay in bed and answer emails.

I understand it's allowed, I just think it's pretty shitty to just say frick it for 6 weeks, I know I wouldn't shut it down for 6 weeks, to help the people picking up my slack if nothing else.
