What else could he do if he had no brakes? Should he have stopped at the top? How do you that if you have no brakes?

Runaway truck ramp, smash the rail, go over a cliff, sacrifice himself essentially.

But yeah, “oops my brakes failed” is a solid reason to pile your rig into stopped traffic and get a slap on the wrist.

Yes, he had options to ditch without killing or injuring a bunch of people.

Like I said earlier, this sentence is an insult to the families of the victims.

5 miles. He had 5 miles of driving without brakes to come up with a different decision. This wasn’t a situation of “oh shite, no brakes... [CRASH]”. He was selfish.

Negligence is what you sue people for, not what you put them in jail for. Justice for the families comes from monetary compensation, not some poor bastard rotting in jail.
