- The jury awarded Liebeck $200,000 in compensatory damages, which was reduced to $160,000 because the jury found her 20% at fault, and $2.7 million in punitive damages for McDonald’s conduct. The punitive damages award was reduced and the parties later settled post-verdict.
thats interesting. so she really only got 160k for her hospital bills. then she lucked out and got the million because they were punishing McDonalds because of their habitual contempt of previous lawsuits.

Yes. The $160K was to cover her medical bills, which were established at trial. And you can bet that her insurance carrier had subrogation rights, so there's no way she got to keep the entire $160K.

The million dollar punitive damage award was reduced by the court and then the parties settled. The settlement figure is confidential and was never released. There's no telling what she actually walked away with. May have been a few hundred grand. May have been a million or 2.

Pay the attorney 2,000 to recoup the $1300 that you lost.

Not my problem since it doesn't affect me, but plaintiffs wouldn't have to come out of pocket to pay an attorney if its a class action. Gordon just gonna get his cut of the settlement after he gets it done.

so they should file a class action law suit, but not get money but get compensated? Should they sue the barge company to get more paid time off from their employers or something?

Is increased traffic really a material and measurable loss? Who was the negligent party? Barge company? Engineering firm that designed the bridge? Port Authority? Do you really want to litigate that and should we really start suing each other for extra time in the car?

He means they should receive compensation for the their actual losses related to having to take a much longer route to work, they should not receive any punitive damages for their misery of having to travel a much longer route.
