This happens a ton in the restaurant industry, and I’m amazed they don’t get sued more often.
Working in a BR restaurant (not Chimes) during college, managers would routinely tell servers to clock out if the restaurant was closed and they were still doing side work before they could leave. Especially if they were on overtime, as others have mentioned.
Most servers didn’t question it, because their actual paycheck basically went to taxes anyway. But it still always struck me as a fricked up business practice.

I am a business owner. I have employees. For obvious reasons, our employees are not allowed to work more than 40 hours a week absent extraordinary circumstances.
I would think that The Chimes also mandates that its employees work 40 hours max a week. We all know that servers make most of their pay from tips. Servers don't get tips before they have tables to serve and they don't want to "waste" hours on times when there aren't tables to serve, so they might wait to clock in until they can get tables and the resulting tips. This would allow them to work more hours that result in tips.

These people can sue for double what they are owed, plus attorney’s fees under the FLSA. Still probably not that much money, which tells me they probably aren’t lying. No one would go through all this shite for $500 to $1000 unless they really thought the Chimes needed to stop ripping people off. Especially three people at the same time.

Annnnd this is the problem for The Chimes. They are obligated to pay workers for those extra hours, regardless of whether they were “optional”.

True, except you still have to find plaintiffs willing to sue their former employer over a few hundred bucks. Being deposed, etc. sucks. The fact that they found 3 ppl willing to do that for a few hundred tells me that these employees are just tying to get chimes to do the right thing and it isn’t about the money for them. Maybe it is for the lawyers...but you need the plaintiffs willing to move forward even though they have almost nothing to gain.

That will be the argument for sure. If The Chimes encouraged this practice (i.e. you are working but not on the clock), that is one thing. If the employees did it voluntarily in order to game the system and make more money for themselves, that is another thing. There are 2 sides to every story.

The IRS will be most interested to know how many hours these waiters worked off the clock while making an algorithmically determined tip wage.
