Did you or the mom move? If she moved to a different town that helps your case.

At what age can a minor decide where he wants to live?

Legally the answer is 18. I know because I'm currently in a custody battle. They will assign a court appointed evaluator and they will talk to the child which will carry some weight, but not as much as I thought it would going in. It's all about what's in the best interest of the child.

Good luck if you go this route though. It's a super long process and lots of $$$. I've had my case filed since May 2017. 3 court dates, a continuance, an evaluation, an updated evaluation and close to $15,000 later and we're still going.

got bad news for you bro, the tab will continue to go up, there will be no decision made(that you'd like,) and before you know it the kid is 18, I recommend cutting the loss and live with it

Understood. Won't get into the dirty details, but I have a very good reason for doing this. Well many very good reasons which have nothing to do with money.

You and your ex wife/baby momma can’t be grown arse adults and agree on the split without involving a court?

gotcha, best of luck with this, sincerely, I went through that and the aggravation and money hemorrhaging only stopped when the ex died, and that was well after the kids were above the age of majority

Sometimes you luck out and get a judge who has a pretty good radar and can see through the crap.

Best of luck to you.

My lawyer said a court won’t allow a 14 year old to make this decision and that it doesn’t help that I’d be at work most of the summer.

What does his mom do during the summer? Teacher?

Are you doing this to improve your kid's quality of life, or is this just part a plan to get retribution for something your ex did? It happens way too often that kids become pawns where one parent is trying to punish the other even if its unintentional.

a - not my case

b - your research would be for your own good, since you're posting inaccurate information out there

I'll raise your $15k retainer fee to $25K settlement fee for me having to point that out to you.

eta: i'm not a lawyer but you can still pay me for my time.

I'll see you in court!!!!

on a serious note, the 19 is true in MS and AL, or at least it used to be, but it seems there is also quite a variety of interpretation of the law among attorneys, i.e., they may not be sure exactly what the law is in certain scenarios, but they will gladly take your money to further their education

She works as a nurse but has a new hubby who is a “stay at home” dad.

Doesn't really seem feasible unless both parents are willing to commit to that schedule.

Thought most states allow kids at 14 to make their decisions about where to stay the bulk of their time. Maybe LA is different.

am divorced with 50/50 custody with my kid. I started letting my kid do what she wanted right off the bat no matter what the court papers said. As far as going to her Moms or staying with me.

Courts attempt a structure for parents that do not get along. It creates culpability.

After a while of seeing how I handled our daughter she finally started coming around to the idea herself and now it's no big deal for either of us.

This is in Louisiana btw as well.

Kid is also 14.

Never stepped back into court another day once the custody arrangements were made.

Y'all be adults about this and work to let your kid be free and not be held to a courts standard ruling.
